    GoBetweenStays – Terms and Conditions

    Welcome to GoBetweenStays (“the Platform”), a website where property owners and managers can list properties for rent and users can find fully furnished properties for short-term stays.

    By accessing or using the Platform, you agree to comply with these Terms and Conditions (“Terms”). If you do not agree with these Terms, do not use the Platform.

    1. Definitions

    • “Platform” refers to the GoBetweenStays website and any associated services provided.
    • “Property Owner” refers to any individual or entity listing a property for rent.
    • “Stayer” refers to an individual seeking to rent a property listed on the Platform.
    • “Property Manager” refers to individuals or companies managing rental properties on behalf of property owners.
    • “User” refers to anyone who registers, browses, or uses the Platform, regardless of whether they list a property or seek accommodation.

    2. User Registration and Accounts

    To access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.

    • General Users: If you register without posting a listing, you may access the Platform’s browsing and search features and interact with other users.
    • Property Owners/Managers: If you are listing a property or managing properties on behalf of an owner, you must ensure your listings are accurate, complete, and compliant with local laws.
    • Stayers: If you are seeking accommodation, you must ensure your profile is accurate and truthful regarding your rental needs.

    You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. If you believe someone has accessed your account without authorization, you should notify us immediately.

    3. Property Owners/Managers Terms

    If you are a Property Owner or Manager, you agree to the following:

    • Property Listings: You are solely responsible for the content and accuracy of your property listing(s), including descriptions, photos, availability, pricing, and terms.
    • Legal Compliance: You confirm that you have full legal rights to rent the property listed, and the property complies with all relevant New Zealand laws, building codes, and rental regulations, including those outlined in the Residential Tenancies Act 1986 and any local council rules.
    • Genuine Listings: You agree to only list genuine properties available for rent and to honor rental agreements made through the Platform.
    • Rental Terms: Any rental agreement made with a Stayer is solely between you and the Stayer. GoBetweenStays is not a party to these agreements and is not responsible for any disputes that arise.

    4. Stayers Terms

    If you are a Stayer, you agree to the following:

    • Genuine Intent: You agree to use the Platform with the intent to genuinely rent a property for short-term accommodation.
    • Rental Agreements: Any rental agreement made with a Property Owner/Manager is solely between you and the Property Owner/Manager. You agree to comply with the terms of the rental agreement.
    • Accuracy of Information: You must ensure that the information in your profile is accurate and truthful, including your rental requirements, payment details, and contact information.

    5. General Use of the Platform

    As a user (whether a Property Owner/Manager, Stayer, or general user), you agree not to:

    • Engage in Fraudulent Activity: You will not use the Platform to engage in fraudulent activities, such as posting fake listings, misrepresenting your identity, or making false claims.
    • Harassment and Discrimination: You will not harass, discriminate against, or engage in abusive behavior towards other users of the Platform.
    • Spam: You will not send unsolicited messages, emails, or advertisements to other users of the Platform.

    6. Fees and Payments

    • Service Fees: GoBetweenStays charges a service fee for the use of the Platform. The details of these fees will be clearly outlined on the Platform and agreed upon before completing any transaction.
    • Payment Terms: You agree to provide accurate payment details and authorize GoBetweenStays or third-party payment processors to charge applicable fees.

    7. User Reviews and Ratings

    Users may leave reviews and ratings for Property Owners, Managers, and Stayers. By submitting a review, you agree to follow the review guidelines and not post defamatory, misleading, or false statements. GoBetweenStays reserves the right to remove reviews that violate these guidelines.

    8. Privacy and Data Protection

    Your use of the Platform is governed by our Privacy Policy, which explains how we collect, store, and use your personal data. GoBetweenStays complies with New Zealand’s Privacy Act 2020 and other applicable privacy laws in managing user data. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy.

    9. Disclaimers

    • Platform Availability: GoBetweenStays is not responsible for any technical issues or downtime that may occur on the Platform.
    • Rental Agreements: GoBetweenStays is not a party to any rental agreements between Property Owners/Managers and Stayers. We do not guarantee the accuracy, completeness, or quality of any property listings or rental transactions.
    • Limitation of Liability: GoBetweenStays is not liable for any losses, damages, or disputes that arise from interactions between users. You agree to indemnify GoBetweenStays against any claims or legal costs arising from your use of the Platform.

    10. Fair Housing & Non-Discrimination Policy

    GoBetweenStays is committed to fair and equal access to housing. We encourage all users—both property owners and renters—to follow fair tenancy laws and make rental decisions based on legitimate criteria such as rental history, references, and ability to pay.

    Discrimination based on race, ethnicity, nationality, gender, age, family status, disability, or any other protected characteristic is strictly prohibited.

    By using this platform, you agree to comply with all applicable tenancy laws in New Zealand and ensure that rental decisions are made fairly and without bias.

    12. Governing Law

    These Terms are governed by the laws of New Zealand. Any disputes that arise from your use of the Platform will be subject to the exclusive jurisdiction of the courts in New Zealand. This includes the enforcement of tenancy rights and obligations as stipulated in New Zealand’s Residential Tenancies Act 1986.

    11. Termination and Suspension

    We reserve the right to suspend or terminate any user account that violates these Terms or engages in illegal or fraudulent activity. This may include, but is not limited to, misleading listings, harassment, or failure to honor agreements made on the Platform.

    13. Changes to Terms

    GoBetweenStays reserves the right to modify these Terms at any time. We will notify users of any changes by updating the “Last Updated” date at the top of this page. Your continued use of the Platform after such changes constitutes your acceptance of the modified Terms.
